Building Regulations 2010 and Building (Approved Inspectors etc.) Regulations 2010

I am writing to inform you that the Building Regulations 2010 and the Building (Approved Inspectors etc.) Regulations 2010 were laid in Parliament on 9 September 2010 to come into force on 1 October 2010.

This contains a correspondence table of regulations in the 2000 and 2010 Regulations.

Consolidated Regulations

The 2010 Regulations in both cases consolidate the Building Regulations 2000 and the Building (Approved Inspectors etc.) Regulations 2000 incorporating all of the amendments made since 2000.

Both sets of Regulations have been renumbered and reordered to make them easier to use and with a more logical structure. A correspondence table showing the previous number of a regulation against the new 2010 regulation number, for each set of Regulations, can be found at Annex A and Annex B of Circular 07/2010.

Please remember that the 2000 Regulations and all amendments to them are revoked from 1 October, i.e. they will no longer be in existence. From that date you should refer to the 2010 Regulations and their regulation numbers in all the work that you carry out.

There have been no changes to the substantive provisions in either set of Regulations, apart from the following:

1.The definition of ‘room for residential purposes’ has been simplified. This can be found at regulation 2(1) of the 2010 Building Regulations.

2.The requirements on information to be given to building owners on the use of fuel and power (previously Part L1(c) in Schedule 1 to the Building Regulations 2000) has now been moved to the main part of the 2010 Building Regulations and appears as regulation 40.

There is no longer a requirement for a statement containing certain information to accompany a building notice involving the insertion of cavity wall insulation as previously required at regulation 13(3) of the 2000 Building Regulations.

Approved Documents and Compliance Guides

Approved Documents and Compliance Guides remain valid for the purposes of the 2010 Regulations. We will be shortly issuing Amendment Slips to allow people to follow the new regulation numbers. The online versions will be amended as soon as possible; the printed versions at the time of the next reprint. .

Statutory Approvals

The statutory approval of methodologies, procedures, circumstances and manners of recording of results for the purposes of the Building Regulations 2000 remain valid for the purposes of regulations 24, 25, 29, 41, 42, 43, and 44 of the Building Regulations 2010.

Competent Persons Schemes (CPS)

These are now listed in Schedule 3 to the Building Regulations 2010.

Please note that we have introduced new categories of work which are covered by Competent Person Schemes:

•the installation of microgeneration and renewable technologies

•the installation of cavity wall insulation in existing buildings

•the replacement of roof coverings in existing buildings

We have also authorised new CPS for existing categories of work and for the new categories of work, and we have extended the scope of work for some of the existing categories. Full details can be seen in Schedule 3 to the 2010 Building Regulations, and the Department’s website will be updated shortly to reflect these changes.

Local Authority and Approved Inspector forms

Local Authorities and Approved Inspectors are reminded that they may need to amend some of their forms to reflect the new regulation numbers.
