Building (Amendment) (Wales) Regulations 2015

Introduction

1.I am directed by Welsh Ministers to draw your attention to the removal and replacement of Schedule 3 (self-certification schemes and exemptions from the requirement to give building notice or deposit full plans) and changes to Regulation 43 (4) (Pressure testing) of the Building Regulations 2010 in relation to Wales.

2.The amendment regulations have been made by the Welsh Minister for Natural Resources in exercise of powers contained in the Building Act 1984.

3.The purpose of this Circular is to draw attention to changes that will come into force on the 31 July 2015.

Schedule 3 and Pressure Testing

4.Schedule 3 to the 2010 Regulations lists all the bodies that have been authorised to operate competent person self-certification schemes for various types of work. Installers who are registered with these schemes are authorised to certify their own work as compliant with the 2010 Regulations without having it checked by a building control body.

5.Amendment regulation 3 amends Schedule 3 of the Building Regulations 2010 to authorise new and extended competent person self-certification schemes and also to revoke the authorisation of schemes for types of work where they are no longer operating a scheme.

6.New row number 4 combines previous row numbers 2, 5, 6 and 7 (Installation of a heating or hot water system, or its associated controls) of the previous schedule in relation to Wales.

7.Amendment regulation 4(a) authorises a new scheme operator for pressure testing of new buildings on 31 July 2015 while amendment regulation 4(b) revokes the authorisation of another scheme operator on 31 December 2015.

8.Annex A to this circular gives full details of the approved new and extended scheme changes and Annex B give full details of the new row numbers and schemes authorised against each work type.
